1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Shree Karunmart ("we," "us," or "our") governing your access to and use of our e-commerce platform, website, mobile applications, and related services (collectively, the "Services").

4. Purchases & Payments

4.1 Product Orders

When you buy an item from us, you make an offer to purchase it. We have the right to accept or reject your order at our sole discretion. A contract is made only when we confirm your order.

4.2 Pricing

All prices are in Indian Rupees (INR) and include applicable taxes. We have the right to change prices at any time without notice. If we make a pricing mistake on a product, we have the right to cancel your order even if we already confirmed it.

4.3 Payment Methods

We accept online payments (UPI, credit/debit cards, net banking, or wallets). We also offer Cash on Delivery (COD) for eligible areas. Please note that choosing Cash on Delivery (COD) requires paying extra delivery fees which will be shown to you during checkout.

4.4 Payment Processing

All payment details you provide must be correct and belong to you. Payments are processed securely. We do not store complete card numbers.

4.5 Order Cancellation

You can cancel your order within 24 hours of placing it, as long as it has not been shipped. We also have the right to cancel orders if the item is out of stock, has a pricing error, or if we suspect fraud.

5. Shipping & Delivery

5.1 Shipping Areas

We currently ship to most areas within India.

5.2 Shipping Timelines

Our shipping and delivery times are divided as follows:

• Processing Time (2 to 4 Days): It takes 2 to 4 days to check, pack, and prepare your items after you order.
• Delivery Time (5 to 10 Days): Once the package is shipped, it takes 5 to 10 days to reach your address.
• Maximum Time (15 Days): In total, your package will reach you in a maximum of 15 days.

Delivery estimates can sometimes change due to courier delays, bad weather, or regional issues.

5.3 Shipping Costs

Shipping costs depend on the delivery location, item weight, and whether you pay online or via Cash on Delivery (COD). COD orders incur extra charges.

5.4 Delivery Risk

The package becomes your responsibility once the courier delivers it to your address.

6. Exchanges Only (No Returns, No Refunds)

6.1 Exchange Policy

We do not accept returns and we do not give cash or money refunds. All sales are final. You can only request an exchange for your item within 7 days of delivery if:

• The item you received is damaged or broken.
• The item is different from what you ordered (wrong size or color).
• The item is unused, has all original tags on it, and is in its original box.

6.2 Mandatory Package Opening Video

To request an exchange for damaged, broken, or missing items, you must record a clear, continuous, and unedited unboxing video when you open the package for the first time. The video must show the parcel label, all sides of the box, and the item being taken out. Without this video, we cannot accept any exchange request.

6.3 Items That Cannot Be Exchanged

Due to hygiene and safety, we cannot exchange the following items:

• Undergarments, lingerie, or swimwear.
• Beauty products and cosmetics that have been opened or used.
• Personalized or custom-made items.
• Clearance or final sale items.

6.4 How the Exchange Process Works

If your exchange request is approved, we will try to schedule a pickup. If pickup is not available in your area, you must ship the item back to us. Once we receive and inspect the item, we will ship the new replacement item to you. If the item is out of stock, only then we will offer store credit or a refund.

7. Product Information

7.1 Product Descriptions

We strive to provide accurate product information, including:

• Product descriptions
• Sizes and measurements
• Colors and materials
• Care instructions

However, we do not warrant that product descriptions, images, or other content are accurate, complete, or error-free.

7.2 Color Variations

Product colors displayed on our Website may vary from actual colors due to monitor settings and lighting conditions.

7.3 Stock Availability

Products are subject to availability. We cannot guarantee that items shown on our Website are in stock.

8. Intellectual Property

8.1 Ownership

All Content on our Website, including but not limited to:

• Text, graphics, logos, images
• Software and source code
• Design, layout, and "look and feel"
• Trademarks, service marks, and trade names

Are owned by or licensed to Shree Karunmart and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.

8.3 Restrictions

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Shree Karunmart and its affiliates, officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or delays

12.2 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid to us in the 12 months preceding the claim, or ₹1,000, whichever is greater.

12.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

13. Warranty Disclaimer

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties of title and non-infringement
• Warranties arising from course of dealing or usage of trade

We do not warrant that:

• Our Services will be uninterrupted, timely, secure, or error-free
• Results obtained from using our Services will be accurate or reliable

14. Indemnification

You agree to indemnify, defend, and hold harmless Shree Karunmart, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your use or misuse of our Services
• Your violation of any law or the rights of a third party
• User Content you submit or transmit
• Your breach of any representations and warranties

15. Termination

15.1 Termination by You

You may terminate your account at any time by contacting customer service or using the account settings.

15.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You breach these Terms
• We suspect fraudulent or illegal activity
• Required by law or legal process
• To protect the rights, property, or safety of Shree Karunmart or others

15.3 Effect of Termination

Upon termination:

• Your right to use our Services immediately ceases
• We may delete your account and data
• Outstanding orders may be honored or canceled at our discretion
• You remain liable for all obligations incurred prior to termination

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

17. Dispute Resolution

17.1 Informal Resolution

Before filing a legal claim, you agree to first contact us and attempt to resolve the dispute informally by sending a written notice describing the claim and proposed resolution.

17.2 Arbitration

Any dispute arising from these Terms or your use of our Services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

17.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Pune, India for any disputes not subject to arbitration.

17.4 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted on an individual basis and not as a class action, consolidated action, or representative action.

We reserve the right to modify these Terms at any time. Changes will be effective:
